Application for bail under section 167(2) of Cr.P.C after put up
the case file.
R/Sir,
The applicant/accused respectfully submits asunder :-
1. That the above noted
case is pending before this Hon’ble court and the same is fixed for 22-08-2019
for awaiting of challan.
2. That the
applicant/accused person has been kept in judicial custody since 13-06-2019.
3. That the police not
investigate the case within 60 days and police also not submitted the challan
against the accused within 60 days, hence the applicant/accused is entitled for
bail.
4. That in the prescribed
period of 60 days the prosecution has bound to produced the challan (Report
under section 173 Crpc.) before this Hon’ble Court but the prosecution has
fully failed to produce the challan before this Hon’ble Court.
5. That the
applicant/accused is ready to furnish the bail bond and surety bond to the
satisfaction of this Hon’ble court.
6. It is therefore prayed
that the accused may kindly be released on bail under section 167(2) Cr.P.C, in
the interest of justice.
