Subject: Demand Notice U/s 2-A of Industrial Disputes Act.

Sir,

I, __________________was appointed as Die Maker in the year 1990 and has been promoted as Senior Die Maker in the year 2001 and my last drawn salary was Rs. 15000/-. That I worked almost 16 years in your company continuously without any break. During my service period, my work was quite satisfactory.

That you have not paid my salary from the period of 01.03.2010 to 31.05.2010 alongwith the overtime of 4 hours per day as well as terminal benefits as per Shop & Factory Acts which comes to Rs. 2,42,500/-.

I requested you to pay my salary alongwith the overtime of 4 hours per day, but you did not pay my earned wages which is pending for the above said period. You assured me that you will be paid the earned wages as soon as possible, but you have failed to pay any earned wages.

That on 01.06.2010, you stopped my gate entry without any reason and said your services no longer required by the company.

That on 01.06.2010, you terminated my services without following of 25 of industrial Disputes Act and you have not issued any charge-sheet, show cause notice or termination letter. I continuously went to your factory, you assured me that you will take me on duty, but you finally refused on 01.06.2010 and said we will not take you on duty and your full and final will be sent on your postal address as soon as possible. My services was terminated by you without any reason or following any principles of natural justice.

In view of the above, it is most respectfully prayed that you will take back me on duty with continuous services with full back wages.

2. That the applicant has came to know that the employer/respondent is selling away the machinery as well as the property situated at Shed No. _______________ before the disposal of this application/claim petition being filed by the undersigned.

3. That if the employer/respondent succeed in his motive to sell the property in question then the applicant/workman will suffer an irreparable loss and injury which cannot be compensated in any manner and the workman/applicant will not get anything from the employer/respondent and the present application filed by the applicant will not succeed and become infructuous and will not serve any fruitful purpose.
